The California Teachers Association, one of the largest and most dynamic professional labor associations in California, seeks an experienced attorney to join its Legal Department located at CTA Headquarters in the Bay Area.

This position presents exciting opportunities to litigate emerging issues in the areas of education and labor law. This attorney will be expected vigorously to enforce and expand the constitutional and statutory rights of public school employees, protect employees’ concerted activity and bargaining rights through unfair practice charges, and provide support to CTA organizers and field staff who prosecute grievances to arbitration, launch strikes and other workplace actions, secure collective bargaining agreements, advocate for students, and represent members and local union chapters in a wide variety of matters. This attorney will be called upon to respond quickly and reliably to a wide range of inquiries on topics that include constitutional rights, union governance, charter school organizing, collective bargaining, employment law, special education, school funding, associational rights, and much more. The ability to research thoroughly and write persuasively on these and other topics is required. Effective oral advocacy on behalf of CTA and its local chapters and members is similarly essential, not just before administrative agencies and boards, but also federal and state courts at the trial and appellate level. In addition, this attorney will contribute to the drafting of legislation and the evaluation of legislative proposals on some of the most significant issues facing educators in California today.

This attorney will represent CTA’s members and local chapters throughout the State of California. This attorney will be joining a highly collegial working environment where the open and frequent exchange of ideas is encouraged and expected. The position also requires a significant degree of autonomy. Both a cooperative style and the willingness to take individual responsibility are needed.

Duties and Responsibilities

·         Investigate, research and analyze facts and law to advise CTA staff, chapters and members on questions of education, employment, labor and other laws.

·         Pursue litigation before courts and administrative agencies on behalf of CTA, its chapters and its members. Perform all related functions such as devising legal strategy, drafting/editing legal briefs, presenting evidence and oral arguments at hearings, and negotiating settlements.

·         Identify legal issues and analyze whether, and how, they should be pursued to further the objectives of CTA, its chapters and CTA members.

·         Work with CTA staff to represent chapters and members in contractual disputes before an arbitrator.

·         Train and develop training materials for CTA officers, staff, chapters and members on issues of education, employment, labor and other laws.

·         Analyze legislative proposals and draft legislation to further CTA’s objectives.

·         Manage a substantial and varied caseload.

·         Perform other duties as assigned.

Qualifications – Minimum Required

·         Juris Doctorate.

·         Membership in State Bar of California or the bar of another state. Holder of out of state bar membership must pass California State Bar within a reasonable period after hire.

·         Prior labor and/or employment and/or education law practice strongly preferred.

·         Prior representation of labor unions and members strongly preferred.

·         Ability to write quickly and persuasively and tailor one’s writing to varied audiences such as judges, employers, CTA staff, elected union leaders, and rank-and-file members.

·         Ability to speak persuasively to courts and administrative law judges as well as groups of CTA leaders, staff, and members on legal topics.

·         Ability to analyze complex legal issues thoroughly and comprehensively and to convey the results with precision both in writing and orally.

·         Ability to work as part of a team in a challenging and collaborative environment.

·         Ability to manage multiple priorities and short deadlines.

·         Ability to obtain and maintain a valid California driver’s license.
